WILLS
AND PROBATE
DOCUMENTS
State laws regarding who can
make healthcare decisions for you when you are incapacitated
may not be in accordance with your wishes. Likewise, state
laws regarding the distribution of property upon death may
not provide for your family as you intend.
Messer, Campbell & Brady, LLP
helps you plan for the future with simple wills and related
documents that preserve assets for surviving family members
and prepare for catastrophic health issues.
Simple Will - This basic document outlines who will
inherit your assets upon your death, and how they will be
distributed. A simple will does not create trusts.
Directive to Physicians - Also called a "living
will," this gives specific instructions to your family
and health care providers about life support and heroic medical
measures if you become ill.
Medical Power of Attorney - This enables a spouse or
other designee to make health care decisions on your behalf
if you are incapacitated.
Durable Power of Attorney - If you are not able to
handle your own affairs, a pre-appointed family member or
friend can make financial and business decisions in your place.
Guardianship - This arrangement provides financial
care and personal oversight of a minor child or an adult with
special needs, if you die or become incapacitated.
PROBATE
ADMINISTRATION
"Probate" is the process of proving the validity
of a will through a court proceeding. However, a will does
not always exist and so laws are established in Texas to deal
with the orderly distribution of assets to those who are entitled
to inherit them, generally after being reviewed or monitored
by a judge or other court-appointed person. All property is
said to be owned by the "estate" of the deceased
person and must remain so until the probate process is complete
and the judge or other court-appointed person says it may
be distributed.
Probate issues can be very confusing and can place a great
deal of stress upon families. Messer, Campbell & Brady, LLP can assist
you in probating wills in Texas with the professionalism and
sensitivity needed for such delicate matters.
